1. Agreement to Terms

These Terms of Service (“Terms”) govern your access to and use of The Fly Market, operated by Two Guys Flies (“we,” “us,” “our”), including the website, marketplace listings, and all related services (collectively, the “Platform”). By creating an account, browsing, purchasing, booking, or registering as a vendor, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

2. What The Fly Market Is

The Fly Market is an online marketplace that connects anglers with independent, third-party vendors — including fly tyers, artists, guides, outfitters, and lodge owners — who list and sell their own products, guided trips, and lodging. Two Guys Flies does not manufacture, tie, guide, own, or operate any of the products, trips, or properties listed on the Platform. Each listing is created and fulfilled directly by the vendor, who is solely responsible for the accuracy of their listing and the quality, safety, and delivery of what they offer.

3. Accounts

You must provide accurate, current information when creating a customer or vendor account and are responsible for keeping your login credentials secure. You are responsible for all activity that occurs under your account. Notify us immediately if you suspect unauthorized use of your account.

4. Vendor Terms

  • Vendors must accurately describe their products, guided trips, or lodging, including price, availability, and any material limitations or risks.
  • Vendors are independent third parties, not employees, agents, or partners of Two Guys Flies.
  • Two Guys Flies retains a service fee (currently 15%) on products and services sold through the Platform; remaining proceeds are paid to the vendor via automated payout.
  • Vendors must hold any licenses, permits, insurance, or certifications required by law to sell their products or provide guiding, outfitting, or lodging services.
  • Vendors agree to the Vendor Waiver & Confidentiality Agreement executed at registration, including keeping customer information confidential and using it solely to fulfill orders.
  • Two Guys Flies conducts ongoing product and vendor audits and may suspend or remove any vendor or listing that violates these Terms or fails to meet marketplace standards.

5. Orders, Payments & Cancellations

All payments are processed through secure, PCI-compliant third-party payment processors; Two Guys Flies does not store your full credit card information. Cancellation, rescheduling, and refund policies for guided trips, lodging, and physical products are set by the individual vendor and disclosed on the listing at the time of purchase or booking. Contact the vendor directly, or reach out to us for help resolving an order issue.

6. Guided Trips, Lodging & Assumption of Risk

Fly fishing, guided trips, and related outdoor activities involve inherent risks, including but not limited to risk of injury, exposure to natural elements, water hazards, and travel to remote locations. By booking a guided trip, lodging, or any outdoor experience through the Platform, you acknowledge and voluntarily assume these risks. Guides, outfitters, and lodges may require you to sign an additional liability waiver before participating — you are responsible for reviewing and complying with any vendor-specific waiver, safety instructions, or requirements.

7. Intellectual Property & Vendor Media

All photos, videos, product images, and other media uploaded by a vendor remain the sole property of that vendor and are protected under copyright law. Two Guys Flies is granted a limited license to display this content solely to operate and market the Platform. The Fly Market name, logo, and site design are the property of Two Guys Flies and may not be used without permission.

8. Prohibited Conduct

You agree not to:

  • List, sell, or misrepresent counterfeit, stolen, illegal, or unsafe products or services.
  • Attempt to circumvent the Platform to avoid service fees or conduct transactions off-platform in bad faith.
  • Harass, defraud, or misrepresent your identity to another customer or vendor.
  • Interfere with the security, integrity, or normal operation of the Platform.

9. Disclaimers & Limitation of Liability

The Platform is provided “as is” and “as available.” Two Guys Flies makes no warranties regarding the quality, safety, legality, or fitness of any vendor’s products, guided trips, or lodging, and is not a party to the transaction between customer and vendor. To the fullest extent permitted by law, Two Guys Flies is not liable for any indirect, incidental, or consequential damages arising from your use of the Platform or your dealings with any vendor.

10. Termination

We may suspend or terminate your access to the Platform at any time for violation of these Terms, fraudulent activity, or conduct that harms other users or the marketplace’s integrity.

11. Governing Law

These Terms are governed by the laws of the State of NC, without regard to conflict-of-law principles.

12. Changes to These Terms

We may update these Terms from time to time. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms. The “Last updated” date above will always reflect the most recent revision.
