Lodging and private-water access

These Terms & Conditions govern property listings and bookings on The Fly Market, including cabins, vacation rentals, and private fishing access.

Last updated: October 12, 2026

1. About these terms

These Property Vendor Terms supplement the general Terms of Service for The Fly Market, operated by Cobb Consulting — Eugene Cobb (“we,” “us,” or “the marketplace”). “Vendor” means the property owner or authorized operator responsible for the listing and fulfillment of the booking.

These terms apply to lodging and private-water access listings, including day-use fishing access without lodging. They do not set category-specific fulfillment or payout terms for fly tiers, guides, artists, or other product vendors.

By registering as a property vendor or using our property-listing features, you agree to these terms and the general Terms of Service. If you do not agree, do not use those features. These terms take precedence for property-specific matters where they differ from the general Terms of Service, subject to applicable law.

2. Free setup, listing migration & marketing

Standard professional setup is free. We can help configure your storefront and listing, copy an existing listing you are authorized to use, and connect supported iCal calendars. You must review and approve descriptions, prices, booking rules, tax settings, and availability before accepting bookings.

Standard marketplace promotion is included at our expense. This does not promise a minimum advertising budget, ranking, traffic level, or number of bookings. Any optional property-specific paid campaign charged to you requires your prior written approval of its budget and payment responsibility.

You retain ownership of your listing content and grant us a nonexclusive license to display and use approved content to operate and promote your listing and the marketplace. You must have permission to use all submitted photos, text, and other materials.

3. Commission & payment-processing charges

  • Standard commission: The marketplace charges a 9% commission on eligible booking charges.
  • Special rates and promotions: A separately confirmed promotional or individual rate may apply to an eligible vendor. Eligibility, duration, and any booking restrictions are provided separately. Special rates do not change the standard commission for other vendors.
  • Calculation: Commission applies to booking charges retained by the vendor, including separately charged cleaning or service charges, but excludes separately itemized sales or lodging taxes and refundable security deposits. Refunded booking charges are excluded from the final commission calculation.
  • No other standard marketplace fees: No upfront setup, listing, monthly subscription, or mandatory marketing fee.

Payment-processing fees are separate from marketplace commission and are passed through at actual cost without a marketplace markup. The enabled payment gateway may be Stripe or WooPayments; the gateway used and applicable charges should appear in transaction records.

For reference, Stripe’s published standard U.S. online domestic-card rate is 2.9% + $0.30 per successful transaction. Actual fees depend on the gateway, account pricing, payment method, card origin, and currency. International-card, currency-conversion, dispute, or other processor charges may apply at cost; any applicable fee schedule must be disclosed to the vendor before accepting bookings.

Processing charges may apply to the full amount processed, including taxes, even when those amounts are excluded from the commission base. Any commission promotion does not waive processing charges unless its separate terms expressly say so.

4. Payout schedule

Payouts are scheduled to be initiated on the first business day after guest check-in. Bank receipt may be later because of payment-processor and bank settlement times.

A business day is Monday through Friday, excluding U.S. bank holidays. The property’s local check-in date is used. For private-water access without lodging, the scheduled start date of the booked access period serves as the check-in date for payout scheduling.

Payouts are net of applicable commission, actual processing charges, refunds or disputes, and amounts the marketplace is legally required to collect or remit. A booking statement should show the gross payment and deductions.

The schedule requires cleared funds and a verified, eligible payout account. Processor-imposed holds or reserves, suspected fraud, disputed payments, legal restrictions, or incomplete verification may delay a payout. We will notify you of a known delay and its reason when legally permitted. This schedule is not a guarantee of next-business-day bank deposit.

5. Calendar synchronization & double bookings

Our channel manager supports iCal imports and exports of booked or blocked dates. It is not a real-time connection and does not synchronize prices, guest information, payments, or all platform-specific booking rules. The frequency at which an external platform reads an exported calendar is controlled by that platform.

Marketplace imports run on the configured scheduled process; actual timing depends on the hosting scheduler and successful feed retrieval. A two-minute scheduler does not guarantee that every connected calendar updates within two minutes. Airbnb currently states that its imported calendars refresh automatically every three hours; other platforms may differ.

You must keep every calendar accurate, confirm feed connections and time zones, promptly block dates when needed, and review new reservations. Do not assume that an imported external block is re-exported to another platform. Connect your external booking platforms directly to one another where needed.

The property owner is responsible for resolving double bookings. If a conflict occurs, promptly contact the affected guests and the marketplace, correct availability, and arrange an appropriate alternative, rebooking, or refund under the applicable booking policies and law. You must also coordinate with any affected external booking platform. Calendar synchronization cannot guarantee that conflicting bookings will never occur.

This allocation of operational responsibility does not waive mandatory consumer protections or responsibilities that the marketplace cannot lawfully exclude.

6. Sales, lodging & occupancy taxes

You must supply accurate property-location and tax information and comply with applicable registration, reporting, collection, and remittance requirements. You are responsible for taxes the law assigns to you.

Where applicable law requires the marketplace to collect and remit a tax, the marketplace will perform that obligation. A website setting or special vendor arrangement does not override a legal tax duty. Responsibility for each applicable tax must be confirmed before accepting bookings to avoid duplicate collection.

Tax calculation depends on properly configured product, location, and tax settings. Do not assume that importing a listing or calendar automatically configures taxes. Your own income and business taxes remain your responsibility.

7. Guest cancellations, refunds & disputes

Your cancellation, rescheduling, no-show, and refund policies must be clearly disclosed before checkout and comply with applicable law. The policy presented when a booking is made governs that booking; it cannot be made more restrictive retroactively.

Notify the marketplace promptly when a refund or booking adjustment is needed so it can be handled through the original payment workflow. Refunds and chargebacks may reduce an unpaid payout. If proceeds have already been paid, the corresponding amount may need to be returned or reconciled against later payouts, with an itemized accounting and subject to applicable law.

Processing fees may not be returned by the processor when a payment is refunded. Actual unrecovered processing charges and applicable dispute charges are handled under the disclosed processor fee schedule and any separately confirmed vendor terms. No processing charge will be withheld from a guest’s legally required refund merely because the processor does not return that fee.

You must provide timely booking and fulfillment information needed to respond to disputes. Guest rights under applicable law are not limited by a vendor policy or by termination of vendor participation.

8. Property-owner responsibilities

  • Be the owner or have authority to list and operate the property or fishing access, and keep contact, payment, pricing, and availability information accurate.
  • Maintain legally required permits, licenses, insurance, and permissions, including any required fishing-access rights.
  • Clearly disclose access boundaries, permitted activities, occupancy, amenities, fishing restrictions, seasonal closures, safety risks, fees, and material limitations.
  • Honor confirmed bookings, provide check-in or access instructions, maintain safe conditions, and respond promptly to guests and booking issues.
  • Protect guest information, use it only for authorized booking fulfillment or another lawful purpose, and do not add guests to marketing lists without a lawful basis.

You operate independently and are not an employee, agent, or legal partner of the marketplace. Marketplace participation does not transfer responsibility for the operation of your property to us.

9. Removing a listing or ending participation

You may list on Airbnb, Vrbo, your own website, and other services. There is no exclusivity requirement or minimum participation term.

You or the marketplace may end vendor participation immediately, without advance notice. You may pause your listing or stop accepting new bookings through available dashboard controls, or contact us to request removal. There is no marketplace termination fee.

Ending participation, pausing a listing, or removing a listing does not automatically cancel confirmed guest bookings or remove amounts already owed. Existing reservations, guest communications, applicable taxes, refunds, disputes, and final payouts must still be resolved. A final itemized statement will be provided when outstanding amounts can be determined.

We may restrict a listing or account immediately for fraud, unlawful activity, safety concerns, or violations of applicable terms. Responsibilities for existing bookings, payment reconciliation, confidentiality, and legally required records continue after participation ends.

10. Updates, general terms & applicable law

We may update these terms and will communicate material changes before they apply to new bookings. Changes do not retroactively alter the commission or cancellation policy of an existing confirmed booking. Separately confirmed special rates remain subject to their stated conditions. The last-updated date appears at the top of this page.

The general Terms of Service also govern acceptable use, marketplace content, disclaimers, and dispute matters to the extent consistent with these property-vendor terms and applicable law. These terms are governed by North Carolina law, subject to mandatory laws that apply to the property, transaction, or parties.

Nothing in these terms excludes a right, remedy, or obligation that cannot lawfully be excluded. If a provision is unenforceable, the remaining provisions remain effective to the extent permitted by law.
