The Fly Market / Two Guys Flies
Product Vendor Terms & Conditions
Last updated: October 14, 2026
These terms apply to vendors selling physical products through The Fly Market, including art, fly-fishing gear, apparel, and approved outdoor accessories.
Free setup assistance: Help configuring your storefront, products, and supported shipping settings.
Commission: 15%, unless a different rate is agreed upon in your Vendor Agreement, plus applicable payment-processing fees.
Payment timing: Funds are released upon shipment, subject to available funds and account eligibility. Payment upon order may be agreed upon for a business reason.
This summary does not replace the full terms below or your separately agreed Vendor Agreement.
1. About these terms
By registering as a product vendor or using the marketplace’s product-selling features, you agree to these terms and the general Terms of Service. If you do not agree, do not use those features.
These terms govern physical-product sales, not lodging, private-water access, or guide-service bookings. Property listings remain subject to the Property Vendor Terms. Any separately confirmed terms for another vendor category continue to apply to that category.
These terms take precedence for product-specific matters where they differ from the general Terms of Service, subject to applicable law. A separately agreed Vendor Agreement controls an expressly agreed commission rate or payout arrangement. No agreement overrides a legal obligation that cannot be waived.
2. Free setup assistance & product content
Standard assistance setting up your storefront and products is free. We can help with product descriptions, images, prices, variations, and supported shipping settings. You must review and approve your listings, inventory, shipping charges, tax information, and customer policies before accepting orders.
You retain ownership of your submitted content and grant the marketplace a nonexclusive license to display and use approved content to operate and promote your products and the marketplace. You must own or have permission to use every submitted image, description, design, trademark, and other material.
Setup assistance does not transfer responsibility for your products or guarantee a particular sales volume.
3. Commission & payment-processing fees
- Standard commission: 15% on eligible product sales, unless a different rate is agreed upon in your Vendor Agreement.
- Different rates: Any alternative rate, its duration, and its conditions must be confirmed in the Vendor Agreement. It does not change the standard rate for other vendors.
- Calculation: The commission calculation, including treatment of shipping charges and discounts, must be confirmed in your Vendor Agreement or written fee schedule before you accept orders. Separately itemized sales taxes are excluded from marketplace commission.
- Processing fees: Applicable credit card and other payment-processing fees are separate from marketplace commission. Processor pricing can vary by payment method, account, card origin, and currency. Applicable charges must be disclosed before you accept orders.
- Refunds: Commission is reversed on fully refunded product charges and adjusted for partially refunded product charges. Processor-retained fees are handled under section 7.
Processing charges may apply to the full payment, including shipping and taxes, even where those amounts are excluded from the commission calculation. Any optional expedited-payout fee must be disclosed before that payout option is selected. A special commission rate does not waive processing fees unless expressly agreed.
4. Shipping costs & order fulfillment
Vendors configure their shipping costs and delivery destinations using the marketplace’s supported shipping settings. Review your shipping origin, available destinations, rates, handling times, and delivery restrictions before making products available for purchase.
- Use the shipping methods supported for your storefront, such as flat-rate shipping, supported calculated rates, or clearly defined free-shipping offers.
- Account for packaging, postage, and any insurance or tracking you choose to include. Keep product weights, dimensions, and shipping classifications accurate where those settings affect the rate.
- Clearly disclose any conditions for free shipping, destination restrictions, and production or handling times for custom or made-to-order products.
- Review how charges are calculated for multiple items, variations, and combined orders. Separate shipping charges may apply to products from different vendors and must be disclosed before checkout.
- Verify your configured rates before accepting orders and update them when your costs or delivery options change. Do not impose an undisclosed shipping charge after an order is placed.
Free assistance is available to help configure supported shipping settings. You remain responsible for approving the rates and making sure they cover the delivery service you promise.
You are responsible for maintaining inventory, packing products safely, shipping to the address on the order, meeting the handling times stated in your listing, and providing shipment confirmation and tracking information when available. Record shipment through the supported marketplace workflow so order status and vendor-payment eligibility can be reviewed.
If you cannot ship as promised, promptly notify the customer and marketplace and arrange a lawful revised delivery date or cancellation and refund. Creating a shipping label alone does not establish that an order has shipped; the package must be handed to the carrier or other agreed delivery service.
International sales, if supported and offered, require clear disclosure of delivery limitations and responsibility for customs duties and import charges, subject to applicable law. Do not enable destinations you cannot lawfully serve.
5. Vendor payments & Stripe Connect
The standard payment trigger is shipment of the order. Vendor funds are released upon confirmed shipment, subject to cleared and available funds, required account verification, and payment-processor restrictions.
Payment upon order may be approved where there is a business reason for that arrangement. The exception and any conditions must be agreed upon in the Vendor Agreement before it applies. It is not an automatic entitlement for every order.
The marketplace is adopting Stripe Connect for vendor disbursements. When enabled for your storefront, you must complete the required connected-account onboarding and maintain accurate payout information. Any interim payment arrangement must be confirmed before you accept orders.
Releasing funds or transferring them to a connected Stripe account is not the same as their arrival in your bank account. Actual availability and deposit timing depend on Stripe’s settlement rules, account eligibility, payout settings, and your bank. Instant Payouts may be available to eligible accounts and balances, subject to Stripe’s requirements and disclosed fees; an immediate bank deposit is not guaranteed.
Payments are net of applicable commission, processing fees, vendor-responsible refunds or dispute amounts, and taxes the marketplace is required to collect and remit. Order statements should identify the gross payment, deductions, and adjustments.
Incomplete verification, unavailable funds, processor holds or reserves, suspected fraud, disputed payments, or legal restrictions may delay payment. We will notify you of a known delay and its reason when legally permitted. For partially shipped orders, any partial release must be agreed upon and accounted for separately; shipping one item does not establish shipment of the entire order.
6. Sales tax & other taxes
The Fly Market will collect and remit sales tax where applicable law requires it to do so as a marketplace facilitator. A vendor agreement or website setting does not transfer a mandatory marketplace tax obligation to the vendor.
You must provide accurate business, shipping-origin, product, and tax information needed to determine applicable taxes. Tax treatment can vary by destination, product type, shipping charges, exemptions, and jurisdiction.
You remain responsible for tax registration, reporting, collection, and remittance obligations that the law assigns to you, including obligations relating to sales outside the marketplace. Your own income and business taxes remain your responsibility.
Responsibility for applicable taxes and the handling of tax funds must be confirmed before accepting orders to prevent missing or duplicate collection. Where applicable, marketplace statements will identify taxes collected and amounts withheld from vendor payments for remittance.
A checkout tool calculating or charging tax does not, by itself, establish that a tax return has been filed or the tax remitted. Neither storefront setup nor Stripe Connect onboarding replaces required tax compliance.
7. Cancellations & processing fees
Your cancellation and refund policies must be clearly disclosed before checkout and comply with applicable law. The policy presented when the order is placed governs that order and cannot be made more restrictive retroactively.
Customer cancellations
When a customer cancels an order, the customer is responsible for actual payment-processing fees that the processor does not refund, provided this policy was clearly disclosed before checkout and the deduction is permitted by applicable law. Any remaining refund follows the cancellation policy presented when the order was placed. No additional cancellation fee may be imposed unless previously disclosed and lawful.
This rule does not permit a fee deduction from a legally required full refund or shift vendor-caused cancellation costs to the customer. A refund request arising from defective, misrepresented, undelivered, or otherwise legally refundable goods is not automatically treated as a discretionary customer cancellation.
Vendor cancellations
When a vendor cancels an order, the customer receives a full refund, including shipping charges for the cancelled order, without a cancellation or processing-fee deduction. The vendor is responsible for payment-processing fees that the processor does not refund.
For a partially cancelled order, refund the cancelled items and the associated shipping charges as applicable. Do not retain charges for a shipping service that will not be provided.
Refund handling
Cancellations and refunds must be handled through the marketplace’s original payment workflow. Notify the marketplace promptly when an adjustment is needed. Marketplace commission is reversed on fully refunded product charges.
If you have already received payment, vendor-responsible refund amounts and processor-retained fees may be reconciled against available funds or repaid, with an itemized accounting and subject to applicable law. Do not issue an outside refund that could cause a duplicate refund or prevent correct payment reconciliation.
8. Returns, damaged goods & delivery issues
Before checkout, clearly disclose your return-request window, return conditions, process for obtaining return instructions, and responsibility for return shipping. Any lawful restrictions for custom, personalized, or other nonreturnable products must be stated before purchase and cannot override mandatory customer rights.
For an ordinary change-of-mind return, responsibility for return shipping follows the policy disclosed before checkout, subject to applicable law. Customers must not be charged undisclosed return fees.
If a product is incorrect, defective, damaged, materially misrepresented, or not delivered as required, promptly cooperate with the customer and marketplace to arrange an appropriate replacement, refund, or other lawful remedy. The customer must not be required to bear costs that applicable law assigns to the vendor or marketplace.
You are responsible for maintaining fulfillment records and assisting with carrier claims for lost or damaged packages. Carrier claims and tracking status do not remove a customer’s legal rights or justify delaying a legally required remedy.
9. Chargebacks & payment disputes
A chargeback is a dispute raised through a customer’s bank or card issuer and is separate from an ordinary cancellation. Promptly provide requested order, shipment, tracking, delivery, and customer-communication records so the marketplace can respond within processor deadlines.
Responsibility for disputed amounts and dispute fees will be assessed under the Vendor Agreement, the reason for the dispute, fulfillment records, processor rules, and applicable law. Any vendor-responsible deduction or reconciliation must be itemized. The property-vendor fraud-protection policy does not automatically apply to product vendors.
Customers are not automatically charged a penalty for exercising legitimate dispute rights. Payment-processor holds may temporarily affect fund availability while a dispute is reviewed.
10. Vendor responsibilities
- Have authority to sell your products and keep your contact, account, pricing, inventory, and payout information accurate.
- Provide truthful descriptions, images, sizes, materials, condition, compatibility information, and material product limitations.
- Sell only lawful, approved products and comply with applicable safety, labeling, intellectual-property, licensing, and recall requirements.
- Observe destination and carrier restrictions for knives or other regulated goods. Do not assume marketplace approval establishes that a product may be sold or shipped everywhere.
- Honor accepted orders and disclosed customer policies, and respond promptly to order notifications and customer issues.
- Monitor your Vendor Dashboard and notification email, including spam folders. Email delivery can be delayed or filtered and does not replace order monitoring.
- Protect customer information and use it only for authorized order fulfillment or another lawful purpose. Do not add customers to marketing lists without a lawful basis.
You operate independently and are not an employee, agent, or legal partner of the marketplace. Marketplace participation does not transfer responsibility for your products or business operations to us.
11. Pausing listings or ending participation
You may pause products or request removal of your storefront by contacting the marketplace. The marketplace may restrict or remove products or accounts for unlawful activity, fraud, safety concerns, or violations of applicable terms.
Pausing a listing, removing a storefront, or ending participation does not automatically cancel accepted orders or remove amounts already owed. Outstanding orders, refunds, returns, taxes, disputes, and final payments must still be resolved under the applicable terms and law.
A final itemized accounting will be provided when outstanding amounts can be determined. Responsibilities for payment reconciliation, customer confidentiality, and legally required records continue after participation ends.
12. Updates, general terms & applicable law
We may update these terms and will communicate material changes before they apply to new orders. Changes do not retroactively alter the commission or customer cancellation policy of an existing accepted order. Separately agreed rates and payment arrangements remain subject to their stated conditions.
The general Terms of Service also govern acceptable use, marketplace content, disclaimers, and dispute matters to the extent consistent with these terms and applicable law. These terms are governed by North Carolina law, subject to mandatory laws that apply to the transaction or parties.
Nothing in these terms excludes a right, remedy, or obligation that cannot lawfully be excluded. If a provision is unenforceable, the remaining provisions remain effective to the extent permitted by law.
